if the buyer really did find all of that on the computer, than i think that it's too bad for the seller... But if he is fabricating that information, that is very bad... libel lawsuit...

It sets up tags in the directory that all the data can be over written, but is not. To really delete, a program which "zeros" a drive is needed, which instead of simply setting all the data as overwrittable, is actually sets all the data to 0's (or 01010101..., or 111111...).
