I'm at a gas station about to use the vaccuum when I hear a pop. Apparently I ran over a beer bottle. It was full so I got some on the paint. Just looked at my tire and it slashed it a bit. Didn't pop the tire or go all the wy through and I don't think I can get it patched.
Anyway, I'm still here but I was wondering if I have any right to claim this on the gas station lol. Is this my negligence for not seeing it or the gas stations for not keeping their property clean. I'm asking from a legal standpoint. What should I do? -------------------- |

did you take pics, or witnesses, otherwise difficult to prove.

yeah, i'm still here. It's some malt beverage so u can see the syrup all over my car and glass shards in the tire. An on the floor near the vaccuum machine

Honestly, you can try to get something out of them, but most places will say they have no control on what is on the outside of the store, and therefore are not liable. Take some pics and talk to the mananger....you might be able to work something out, but I doubt it.

I'd say call the manager or highest person responsible AND the cops. Unless they need evidence that you purposely planted the bottle there...I'd say you might have a chance at some compensation. I assume there's no damage to your paint, though...and if your tire isn't leaking, they'll probably just tell you to go eat it.

Thanks guys. I spoke to the manager and they were pointing fingers at the vaccum company. Lol. Called the cops and he suggested small claims but it's a loooooong process so I'm just gonna take it like a man

You def. have a legal right to file a claim, but in the end it will not be worth it. Small claims can carry a not so small price. The cost of a tire will be well under what you will dish out for a claim. And there is no chance of making the company pay for your fee's either.
