So i recently checked my transmission fluid thinking it might have been low because ive been getting some leaks around the transmission pan and on the differential area so I checked my fluid levels (on level ground while running) and they are slightly above the max mark I'd say about 3mm or so is this any reason to be alarmed?

When you check your fluid, you are warming the engine up to normal temps and shifting through the gears and then checking (while running)? Cause unless you serviced it, fluid dosent magically increase.
If you are having leaks clean up the area to see where the leaks are coming from. There are only a few places it could be leaking from.

Yeah I understand, but last time i serviced it I made sure it was to proper levels, I have a hunch that when I took my car to this shop to have the CV axles replaced they saw fluid leaking from the differential but didnt know that the differential and the transmission case are seperated fluids so I'm guessing maybe they had put some in, I'm kinda tempted to check to see if my differential is up to proper levels now too
