I hope they have computer access in jail because your gonna miss this board for a few days.
![]() QUOTE DO I HAVE A CHACE BASED ON MY EVIDENCE? No, just pay the ticket. And while you are calling the officers pigs, you might as well tell the judge you know he really splits the money for these tickets with the officers when court is over. If I was the judge that reads this, I would be thinking you are guilty right from the start of the story. So let's break it down. QUOTE There was the usual traffic, so I drove slower to save on gas because it would be pointless to speed when all three lanes are full and I won’t be getting to my destination any sooner even if I speed. Sounds like you speed all the time and this was the first time you ever did do under the speed limit. QUOTE He showed me his Lidar gun which clocked me going 49 on a 35 road. You just confirmed what the gun posted as your speed. Only tell them you saw the guns results if asked, no need to help them fry your own @$$. QUOTE Now for a Lidar gun to be accurate it has to be stationed. Laser cannot be used while the cop car/ motorcycle are rolling because the vibrations would scatter the beam everywhere. Are you an expert on this or can you bring someone that is, that will swear to this? If not, your just making yourself look like a know it all which most judges despise. QUOTE The police officer was definitely not stationed because the overpass has no island big enough to safely station a police motorcycle. I was already three-fourth of the way through the overpass when the police officer pulled me over. The officer was on the right lane and tail-gated me as I changed to the left lane. For the officer to be stationed and to catch up to me on time would be unlikely because I was on the right side of the overpass and the island is on the left, the police officer came from right where there is no island at all, just rails so cars don’t flip off the road or something. So basicly you have no idea where the officer was when he clocked you and whether or not he was moving or sitting still? QUOTE I lived in Milpitas for more than 10 years and that overpass is known as PB (pigs bank) because at the other end of the overpass there’s usually one cop in a neighborhood waiting for a speeder to pass by. I would love to see the judges face when he reads this part. Unfortunately, you will be seeing his face soon when he puts out that warrant for your arrest for contempt of court or some other crazy charge. There would be no way to deny it, since you wrote it down in print. QUOTE I have driven through the overpass a few hundred times and I know better than to speed over that area. Back to admitting you speed alot, did'nt we already have this discusion above? QUOTE My car is a mid-engine (engine in the back Toyota mr2. Since it’s a 4 cylinder going uphill is a bit of a struggle because the engine is in the back and the weight slows the car down, so I couldn’t have had speed going uphill. This part is almost as good as the pig bank reference. It does'nt matter where your engine is mounted, your car weighs the same either way and will climb that hill exactly the same. Than you make it sound like the road has an incline like Mt. Everest or something. Maybe the judge should make you have your car inspected to make sure it is fit to be driven on the road since it lacks any power. If your car won't pick up speed on that little incline of a hill, you need to junk it. ![]() Sorry to be so harsh but your story is flawed and you will fry in the chair if you submit that. I have gotten out of many a ticket and also been charged with many too. Basicly it is your word against his since you have no witnesses, and you are helping them convict yourself. The best time to fight a traffic violation is when the officer does something you can use against him or when you have witnesses. I fought one ticket I got because the officer said he heard me speeding and he wrote excessive speeding on the ticket. Now how can you be charged with something when they have no proof? That one took 6 months of going to court (once a month) for my father to finally ask the judge if he could pay it because he had to attend because I was a minor at the time. The judge let me keep the points off my license and barely charged my father anything for court costs, the fine was dropped though. I had another ticket years later for wreckless driving(basicly spinning wheels) and the officer was a complete idiot. He saw the offense earlier that night but never stopped my car until about 2 hours later. I had gotten tired of driving so I let my friend drive my car, and I rode shotgun. My friend finds out that he left his wallet at home with his license in it, and he tells the officer he never spun the tires. So now the officer gives him a ticket for no license and gives me a wreckless driving ticket. I tell him I never spun wheels either and that I did'nt deserve this ticket since he never saw me driving the car. The officer tells me to shut up very rudely. I proceed to keep asking him how can I be driving wrecklessly from the passenger seat? He than unsnaps the gun holder on his holster and pulls out his gun. He tells me one more word from me and he is taking me to jail. I have not showed any signs of agression at all, I just asked a question and wanted an answer. So at this point I tell him to throw me the cuffs and I will put them on and come with him because I was'nt going to take this abuse from him. Since I am willing to go, he won't take me. He decides he has had enough and leaves. Now the funny part is he wrote my friend a ticket for driving with a license, like that is illegal. So we go get his license just in case and proceed to the police department. We ask to speak with the Chief of police and he listens to everything we tell him about this idiot officer. He calls him in to confront him about it with us there. He shows up and we all sit down in a private room to talk. He admits he made an error on my friends ticket and rips it up. He than says he will discuss mine only when my friend leaves the room, but the Chief gets to stay. I'm like ok by me if thats what you want. So me friend leaves and this officers jumps up screaming and shouting that I was a smart @$$ and he was'nt going to do anything about the ticket. He than tells me I should be glad he did'nt have to restrain me. Restrain me? from doing what? I was no where close to this officer the whole time we were pulled over.I was on the passenger side of the car and he was on the other side. My hands were clearly visible because I had them sitting on my roof in plain site. I was never in any way a threat to him and I told him that. He starts screaming more now, so I let him know I would like him to come over to my house when his shift is over, but to make sure he gets his civilian clothes on first. He asks me if I am threating him? I tell him no, I am going to give you a lesson in manners and that it was'nt a threat but a promise. By now the Chief has heard enough, he tells the officer to shut up and proceeds to tear up my ticket and apoligizes for the conduct of his officer. I get to leave while Officer Douchebag gets to stay (with the door closed). ![]() A few years later this officer was let go for sexual harrassing women he stopped. I heard he asked for sexual favors to get them out of tickets. ![]() This post has been edited by gas65: Dec 11, 2004 - 5:49 PM |
