51 in a 30. i figured the limit was 40 because it was a 4 lane road. anyway, after court costs and lawyer fees (to get the ticket taken off record) im in the hole $250. it may not sound like much to you guys, but i have to bag a lot of groceries to make up for it . mods on my celi will be idle for at least 3 months because i have to pay for that, build up $500 for insurance in july, and pay $100/mo for payments. im so pissed i cant do anything to my celi for a while.

If he does read from his notes, you could object. Say that the witness does not have independent recollection of the events and must be dismissed as increditable. If that does'nt work and they allow it, you ask to see the notes that the witness is reading from. (mind game for the cop, because you can ask for things that he can recall that are not on his notes)
As far as paperwork. The trick is to get the cop to testify to his certification and the certification of his equipment. Then after his testimony is over, you say that it is all object and claim heresay and he did not submit the paperwork. Therefore, making his claim insubmissable. If the judge still allows it, he needs to provide his certification to operate a radar gun, the gun's calibration records, and in some states the calibration of the tuning fork used to calibrate the gun. Also, the dates of when all those things were done could get you another technicality. Another fun trick (that only works in a few states) is when you are pulled over to ask to see the speed he clocked you at on the radar gun. If he does not, then you can say in court that he refused to show it to you because he is lying. I tried this one and the judge said that if I was in Wisconsin or some other state (can't remember exactly which ones) that he would have to throw it out. Remember, it's not a matter of the cop's word against yours. Your betting on him not having his ducks in a row. Another bonus is if you pull this stuff and get him on not having his paperwork, everyone in court that goes after you is free to go also. -------------------- |
