Wow, back off everyone and give him a break. I don't think the post said "How big of an idiot do you think I am". Speeding is retarded. Don't get that wrong, I think its retarded because the speed limits are ridiculous. 60 in a 30? I've gotten similar and the road was perfectly straight in the middle of no where and cops jumped out of bushes to get me. They make it low so that they can generate revenue without raising taxes. Its corrupt.
Anyways, I don't know how that cop knew you were going to court but you don't want to even hint to that fact to the cop. You want to be forgetable when you get pulled over. Do not use the odometer story, you could possibly just get a fix-it ticket or more fines. Remember that when you go to court the judge has the option to raise your fine. The cop can tell you he has all the paperwork in the world. But that is all heresay. He has to prove it by bringing it to court. And everytime I have been to court for speeding (which has been ALOT) you plead not guilty and then you wait until everyone else is done, then you have your case right then. Also, ALWAYS ask to see the radar gun with the speed you were going on it. If he can't show that to you, you can say you don't believe him and he was giving you a hard time. Some states are required to let you go if the cop does not show that to you when you ask for it. (FYI, maryland is not one of those states according to my judge) Keep in mind that if you are going for a ticket of 60 in a 30 and say you did not know that you were going that fast, the judge is going to nail you. Obviously 60 does not feel like 30 and he knows it. From my example, the cop jumped out from the bushes and stood in the middle of the street. I explained how fast my car was traveling per second at the speed he said I was traveling, added in reactive time for him to jump out in front of me, rate of travel, and reaction time. Then how far I was away when he started (because of visabilty). Then asked the cop if I was able to easily stop for him without running him over. If I was traveling at an unreasonable speed, I would have killed the pig. Since I did not, and was able to stop without problems of squeeling tires or swerving I could not have been going at an unreasonable speed. Also, dress up for court. Be polite. Do not accuse the cop of lying directly. Give a probable reason for his inaccuracy. Read some books about it, you can even get the cops testimony thrown out if your good. Good luck, fight it. -------------------- |

In my situation, I was kind of rolling hills and there was no way he could see my car until I got to the top. I went back to the scene (I drove there every day to work) and took some pictures. It was a bit unique, so you'd just have to see what you can work with for your situation.
You should go to your local library. I found several books about fighting speeding tickets there that were very helpful. It told you what to say in court, the order of testimony and what the cop was allowed to use. For example the cop should not be allowed to read from notes. He is a eye witness and if he has no independant recollection of the events and needs notes you can point that out and ask to see exactly what he wrote. Then ask him questions that are not on there to establish that he really doesn't recall everything. Anything you can do to establish doubt. After the cop testifies and does not present into evidence his records of certification you can dismiss his entire testimony of certification as heresay and they have to throw his findings out. Just do as much research as you can and don't let them intimidate you. His testimony is based on techinicalities, so thats what you have to disprove. If it is your word against his, you will lose. Its traffic court though, and the judge may let some procedural things go out of order. The judge will appreciate your efforts and consider your fight more if you play by their rules instead of just saying the cop lied and you should let me go. Don't be scared to take the fight to em, you'll find it can be fun to beat them at their own game. -------------------- |

QUOTE(JoKeRkId613 @ Oct 20, 2005 - 12:02 AM) treat another member like they're some kind of idiot or something, check yourself first or just comment on somebody else. You weren't wearing your seat belt. Nuf said. Also, mine we're on freeways where I couldn't runover little children and bambi. You act like you're a 15 year old punk, you're going to get treated like you're an idiot. Also, use paragraphs. Thanks. This post wasn't about calling you an idiot tho, it's supposed to be about you REALIZING you did sometbhing stupid, and you should at least wear your god damn seat belt from now on when you do something stupid. You're talking like you think you didn't do anything wrong. Jesus, I try and tell you you shouldn't splatter your brains on the sidewalk, and you call me a mom? Not everyone has the same opinion on the laws as you do Shid. Sure he should wear a seatbelt, but if the cop thought it was so dangerous in his situation why would'nt he give him a ticket for it?
Would'nt speeding on a highway be more dangerous because the speeds are'nt 30 they are like 65, so to be speeding and get pulled over for that much you got to be doing like 85. That seatbelt is'nt going to do much for you at that speed. Besides he is asking legitimate questions and was just responding to all the negative comments to him when you failed to give him any real advice on what he was asking. -------------------- |

I told him to pay the tickets, thats advice. I told him he was unlikely to get out of either of them, thats advice. I told him he shouldn't go double the posted speed limit, because he'll get pulled over. That's advice. When roads are 30 mph, there's usually a reason unless it's a speed trap by the freeway, etc. When you go 15 over on the freeway, you're in a less hazardess sitation than when you're going double the posted speed limit on a city street. |

It's been my experiance, that if you start something that controversial, or you act rude, you'd better expect crap from people. There's limits to everything, but the biggest issue here is learning and conservation of life. Some of these guys might say it a little meaner than needed, but that doesn't mean what they say isn't important. Joker, you need to lisson to these guys and slow down and wear a seatbelt. Fess up for what you've done, and just be a man about it. I have faith that you can more than be a mature adult about this and handle it in a respectful way and learn your lesson. If you hit someone, that would be horrable, you must admit that. Totalling a Celica should also be a crime, lol. But if you decide to continue your current believes and behavoirs, make sure your not going to wear the seat beat either, because the world could use a few less idiots. Your young, I was young and dumb too at sometime.

Try living in my town, the regular speed limit is 20mph, except in front of the elementry school (during start and end times) it's 25mph, and yes everyone under the age of 50 speeds in this town including the chief of police.
Either way on subject Tweek said it best there isn't much you can do at this time and in Florida the law says the cop doesn't have to show their radar (just like you can refuse to let them search your car, only you can't hide behind a warrant, usually the same rules apply if they deny they lie), be careful next time and being in Florida get a radar detector before any other mod cops will pull you for the fun of it there. Your best plea is the i'm young and i'm dumb, since both tickets are close together you don't have to worry about them checking your record it'll be a month before the first actually makes it to the DMV to become official. You have to ignore shid sometimes, he can get a little excited, but he's right about the seat belt, regardless if your doing 35 or 85 you can die just the same (i've wrecked one time doing a hundred and came out with a seat belt rash, but the same type of car I drove was doing half my speed, wrecked, and the driver and passenger died) but they do save more lives than they cost. |

shid, i'll use paragraphs whenever i want. you're being a smartass right now. so im guessing you tell everyone of your friends that "talk lyk dis" to correct their spelling/grammar. i dont use spell check when posting here nor do i worry about my paragraphs because people understand it just fine. nobody's had a problem with my 1 paragraph. and i was getting off the florida turnpike(highway). that exit is in butt-**** egypt so no kids were gonna pop out or anything. i understand what you're saying. it's not like im hauling ass on the emergency lane on a highway going around a bend not knowing if there's a stranded car around the bend. so know your role and shut your mouth. take care kid, don't hurt yourself.

QUOTE so know your role and shut your mouth. take care kid, don't hurt yourself. As someone who has already made mistakes in the past, done stupid things, and learned their lessons, it is the role of an elder in any society to try and educate the youths who do stupid things and are in the process of those mistakes so they won't make as bad ones. You're not going to stop speeding until you get more tickets and have to pay the financial cost of speeding. But maybe, just maybe, you'll wear your seatbelt if we all get on your case about it. And when you DO get into an accident (because you are neither a safe driver, nor an expierenced one until you have gotten into an accident situation) hopefully you will be wearing your seatbelt, and we won't have to read about you shattering your windshield with your skull. Your situation is akin to juggling a loaded gun, being caught, and then trying to get out of it. It's not smart to juggle a loaded gun, as it could hurt you or others. Maybe you shouldn't have had the gun loaded to begin with, maybe you shouldn't be juggling the gun at all, even if you're a 85 year old WWII, Korea and Vietnam vet that has held a gun since they were 6.
