I got a speeding ticket on the freeway on the express lanes going 79 in a 60 clocked w/ laser. That's a bit faster than what I was going and I'm tired of officers throwing my money away for something I didn't do. I've been doing a lot of reading up on how to beat a ticket. Feb. 3rd I got the ticket, postponed my first hearing from the 15th to the 22nd. Went to court yesterday and plead not guilty. The judge explained to the court that I had a perfect driving record and that I am able to plead no contest to some charge(I'll find out what she called it) and in turn my record will only show a miscillaneous offense and 0 pts. I'll have to find out the fee for this. I meet with the county prosecutor in 3 weeks to discuss my options. I'll keep everyone posted.

What size tires do you have?

uhh, On the scion or my celica. I think my celica has 245/35/19 or 255/35/19. I think they are 8.5 inches wide.

What size tires do you have on the car that was clocked speeding. Maybe your speedo was off and you truly were going as fast as the laser states.
I would have had the officer tell me where they started clocking me and when they stopped, what kind of laser they used, the serial number from the laser and crap like that. Most of the time if you ask enough questions of the sort they will just say F*** it and give you a warning. I know where you're going with this I believe. You're gonna try to say that the speedometer is off due to the tire change. I don't think the change would be that signigant though, so that would probably get thrown out.

If you are truely adamant of of fighting this ticket, here are the tips that SCC gave in their Jan 06 issue:
See if your ticket can be contested using "Trial by Declaration." Which is simply fighting the ticket by mail. Unlike traffic court, trial by declaration offers no financial incentive for the ticketing officer to offer up his version of the events. So in most cases, the officer wont take the time to write up his version of the events and send it in. If he doesnt, there is no case. BUt if he does write it up and you lose, you can then then go to court to contest it with no penalty from losing the trial by declaration. Procrastinate, wait until the last minute to set your arrainment. Reschedule your court date as many times as you can. Every delay will decrease the likelyhood the officer appearing for your case. Even if he does, the memory of the details of your case will be much fuzzier. Join the National Motorist Association and youll have access to legal info to fight your ticket. www.motorist.org Advice on legal question or problems available with pre-paid legal service www.pplsi.com. If its a cop, he may have a report which will refresh his recollection. Also, the cop is going to be there no matter how long its delayed because he is REQUIRED to do so by his job, he gets paid for it, and will be notified by the prosecutor. A lot of cops just feel it is a waist of time, and so they just don't go. aye that happened to my mom not to sure about 1/10 cause all my friends that have gotten tickets weren't so lucky but if u were gonna plee that driving conditions allowd that speed (not sure if they did or not) take some pictures of the road and have a really nice presentation... my friend had posters and stuff for his case and the judge was really impressed in his effort of defense and just let him off with a small fine |

I was listening to the radio a while back and this guy was talking about how he was on his bike going down the freeway doing the speed limit and he gets pulled over. The conversation went something like this..
He askes the officer (a woman, if it matters) how fast he was going. She says 80 miles an hour. Him - "how do you know? Did you clock me?" Her- "No, but I had to do 80 to catch up with you." He paused, then said "does that even make any sence to you? If I was doing 80 miles an hour and YOU were doing 80 as well, how could you catch me? We would keep the same amount of distance the whole time. Simple math would tell you that!" She still gave him the ticket, AND came to court.
