When you get arrested does a cop HAVE TO read you your rights?

no they dont alwasy have to. the miranda is normally read if they are about to question you, not if your are under arrest for something minor.

what you get arrested for?

You do not necessarily need to be read your Miranda Rights. For example a cop doesnt need to state them in order to ask you your name, address ect. Anything they are asking you that could be used in a court against you means they would have to read your miranda rights to you. The other thing is if you make a voluntary statement like " aha yes i did it" that is almost always admissible in court. You made a statement, they didnt ask. Man i love this stuff, carry on.

Hey any time I see someone getting arrested on TV they are read their rights, dont you guys watch COPS wink.gif jk.....

really though I would think they have to read you your rights if they are frikin putting you in hand cuffs

They dont have to read miranda rights at any time. However, if they dont, evidence obtained from you after you have been placed in custody may not later be admissible in a criminal case against you. There are many nuances to this general rule.

rule of thumb for miranda: CUSTODY and INTERROGATION.

if a police officer has you in custody (not free to leave) and they are asking you incriminating questions

ps the answer to your original question is NO.

Its all good i got a lawyer and all that good stuff. Im fine with it - its my parents who are pissed (not so much with me) but with the cop cuz he put their lil baby in handcuffs lol!
