I was driving on the left lane down the 2-lane Lemon St this one windy day when a orange construction sign on the island flew into the front of my car. Ran over it, and snapped into my driver side door. I stopped and looked at the damage, the front bumper has a bad scratch on the left fog corner, fender dented, and door has a hole in it.
Immediately, I called my insurance company. They accepted the claim and advise me to also call the police department to ask for reimbursement for my deductible ($1000). So I called the Walnut Police Department to file a claim or something. They told me that part of Lemon street is not consider Walnut, I should call City of Industry. And, so I did... and those City of Industry fokes told me to make a claim through City of Industry City Hall. Those helpful city hall people sent me a claim form, I filled it out, returned it. 2 weeks later, they called me back stating the construction sign doesn't belong to them, asked me to call the railroad construction company. So I just called, and the dude from the construction company didn't believe me... He simply said "I don't want to entertain your claim, just tell your insurance company to file a suit against us" O_o; So, I yelled the **** outta him. He finally said he's gonna send me a claim form. Though, I felt like they're just gonna reject it once I fill it out and send back to them. What do you say? Should I continue and try to make someone reimburse my loss, or there's no way dude, just eat it and pretend I took a 2 weeks vacation without pay? Sue the SH*T out of them! Walk into any law office around where you live and tell them your story. They'll jump on it! It most likely won't go to court if you have a lawyer contact them and scare them with litigation. If a lawyer is too much for you, then just talk to a clerk at the courthouse and find out what you could do. You shouldn't have to pay for this AT ALL. A sign wasn't secured and hit your car. Not your fault and it is CLEARLY the fault of whoever installed it. In America, the law is supposed to protect against this kind of thing happening to its citizens. Please don't give in and pay for this. You shouldn't have to.

Yea he is right. I'd sue the hell outa them. Thats messed up. You shouldn't have to pay for the damage that someone's construction sign did to your car while you were just driving down the road. i'd contact a lawyer and tell the lawyer everything and if it goes to court i'm pretty sure you got it in the bag.
Specially take pictures. You shoulda took pictures of the sign and all the damage to your car just incase you go to court. This post has been edited by celiracer: Feb 2, 2007 - 2:47 PM -------------------- |
