Just to let some know I did not send as a gift and I also put down on the description a very detailed description of parts expected to receive and meantioned it was an ahead payment by two months. I know I can get my money back, but how long.......I mean my wife is in law school and works at a law firm so getting him to pay legal fees on top of that will be cake. The process, not so cake...... because this is an online transaction, we have to call up paypal and get all that info. Thanks for the support but we really have to do something about this guy dicking everyone.....

Can you clarify the following please:
Did he send you an invoice first to which you replied or did you send in the money outlining what you are paying for? Just because you dont think you sent thing as a gift does not mean that you have not sent it as a gift. Law has nothing to do with paypal. They have bazillion clauses that protect paypal first, then the person who received money and then person who sent money and in that order. -------------------- Captain Pessimist

I personally have bought parts from Jim, got them within a week. So my personal experience is great. I even know him personally. However, I do have customers (now that I work at Tweak'd Performance) who have similar stories to the OPs. I'm on the fence on this one.

This isn't an ideal situation at all.
I have a similar story (although the total value was nowhere near as great as the OP) I was waiting on an ST205 Apex'i intake for my new turbo setup, and after a week of f**king around I gave my engineer the go ahead to make a custom one, well 2 months later my intake finally arrives and I have to put it back up for sale since it's no use to me now. In both of our situations, neither hold up prevented use of the car. Anyhow, as unideal as it is, there was light at the end of the tunnel. You just gotta expect with these sort of things, there's always going to be holdups and it's not uncommon to have a 2 week project turn into a 2 month project simply because parts didn't arrive on time. -------------------- Mike W

I had a clutch change turn from a 1 day job to a 2 week job as I had sent off my engine mounts to get burnt out and filled with polyurethane, the polyurethane only takes 3 days to set, so what happened in 2 weeks? So I've come to accept that the world doesn't stop for me when my Celica needs parts.
That's 2 weeks on the hoist my engineer lost money on. -------------------- Mike W

What concerns me is his unwillingness to come post in this thread and man up about his reliability problems. Waiting for parts for a year is absurd and he should not be allowed to continue stealing from members. I would be all over you, my cc company, the IC3 site, local law enforcement, etc. if you advertised a swap and I didn't have all of it in a month and communication was as poor as Jim's.
I honestly think that he thinks he is "untouchable" because him and Manny are friends. I hope you come down on him hard, Manny. People here are looking up to the Moderators in times like this to get things rolling. -------------------- 1991 MR2 - T-tops - Crimson Red - Gen3 3SGTE - Lots of money

While mods can help in many situations, it isn't their job to be mediators for buying/selling disputes. This is a buyer-beware world and you need to make sure you cover your ass any time you send someone money. The best the board can do is have marketplace ratings so that people have an idea of what a buyer/seller is like, and whether they can be trusted.
Furthermore, sellers need to own up to the fact they maybe overwhelmed with what they can provide. As soon as you have someone's money it is a priority to get their goods out to them in a timely and effective manner. I've read some of the stories on here and people have been waiting months for parts? That's unfathomable. If I don't have what I purchased within a couple weeks, there is hell to pay. And by hell, I'm talking legal action and law enforcement. It's a straight-up crime to take money from someone and not provide the goods/services you are promised. Expect the best, prepare for the worst. Always cover your ass. Don't do a buyer a "favor" by taking a short cut in providing funds, always have a means to prove a transaction occurred (IMs/PMs/E-mails/Receipts etc.) and agree to have a timetable for deliver; this is something lots of people don't do. Put it in writing in the chat logs that the goods are to be delivered by such a date. Don't pay in cash, there's no paper-trail, and no method to get your money back (unless this is a face-to-face transaction). Goodluck, i've been told i've been getting parts anyday now for about 5 months. Prime example of waiting too long. You should have started a process to get your money back about 4 months ago. This post has been edited by Supersprynt: Jun 1, 2011 - 3:05 PM -------------------- |
