This happens all the time with 10 ft steel ladders, wood planks, exploded tires, concrete blocks, dry walls, deer, you name it. and whose fault is it? The guy who dropped these or the guy who ran over these? Silly questions like suing the city for something they didn't do will not only make you feel like a fool but a complete waste of time thats why their is insurance.

Actually, I remember reading a story a while ago (Can't fine the link) but some guy hit a rock on the road and DID successfully sue their City... BUT, they were able to prove that the rock had been there for quite a long time (and was too heavy for an average man to move), and letters had been sent to the City of the danger it posed and asking for it to be removed, which were ignored.
I have also seen locally a few councils get Sued for not maintaining the road and allowing large Potholes to form... Drivers that hit these HAVE successfully sued their council, but this is more of a 'road maintenance' issue, as opposed to hitting a foreign object that is on the road... The OP could possible win the case, but it would be a pretty frivolous law suit... As mentioned before, the best bet is just use insurance... A court-case like this would most likely be thrown out and you would have to pay extra expenses and court costs and even IF you were able to get the case to be heard, there is substantial risk that the city would not be found guilty, again costing court costs etc... -------------------- ------------------------------| White '94 Celica | Bought 11/05/12 | Sold 12/05/15 |------------------------------ |

Depends on how good your government is.
Same thing happened to me, cracked my rim and sliced the tyre. The amount of effort i would have had to take to get them to consider it, and have it shoved back in my face (the majority of people around here have) just wasnt worth it. They would have somehow put it back on me. As with the insurance, it would have cost me more/ruined my insurance reputation/would have shoved it in my face for having a modified 'illegal' car. In your case, i'd say, depending on the rim, and the damage, try look around online to see how other people have been successfull in your city, get a quote from insurance, and put it all up against fixing it yourself or buying a new one!! How can you not go over a 5" rock? The gravel roads here have rocks bigger then that. That or you coulda just gently gone over and avoided it no issue if it was 5" concidering lanes have an extra 6"-1' of space. So I'm with Steve on this one.

As with when it happened to me, not traveling too close, but by the time it appeared from under the car in front, to the time I had to react and try and dodge it, it was too late.
So I dont think its personal responsibility, but maybe that's because I hit a small sledge hammer, not a rock. Continue the inquest! -------------------- |

I couldn't do anything to avoid it. Luckily, it went dead straight under the car and didn't bounce. I wasn't traveling too close to them, and I also couldn't avoid it as it happened so quickly... Lol i dont think is embarrassing at all. But well the wheel is fixed. I didnt know you can actually fix these cracks on a wheel. I found a local shop called 2XL rim repair and they did an excellent job. They even blanced 100%
It cost me $140 so the price was pretty decent. And the city would had paid me if it was a pothole. And no! My car doesnt go over 5 inches rocks. Thats why i tried to avoid it. At first i wanted to sue the city because i was thinking to get a new wheel ($300) plus tire ($140) so almost $450 out my pocke for a rock on the road.... no way.. but it was only $140 so it doesnt matter Anymore This post has been edited by diegohiga: May 16, 2013 - 7:38 AM -------------------- |

So youre saying if I bought a '93 lifted Toyota 22RE 5speed Prerunner that makes me a redneck? I need a truck because it gets kinda annoying driving through the fields and such on my buddies farm. Although it is extremly fun tearing down gravel/dirt roads in the Celica. Trucks are more of a nessicity down here because of farms and such and the roads are in such dismay because of lot them are either A) Hardly traveled B) Over traveled by semis C) Fall inbetween county/city lines so its kind of no mans land Protip - 90% of lifted trucks here have never ever seen a pasture or a gravel road and they never will. Back on topic, honestly I really just wanna say its user error. I'm not trying to beat on your car or anything, it looks great, but cars come factory height for a reason. Therefore you (the user) who lowered car well below factory height (the error) is at fault. Its kinda like where I work at, if your car is lowered and it gets damaged on the track, were not responsable for it because the track designed for factory height vehicles. I saw a lowered Golf come out sideways last year because the frame rail had gotten caught on the track and we told the guy theres nothing we can do about it and the court feels the same way. But thats good you got it fixed for $140, if its that cheap to get rims fixed I might need to go get mine done. They've seen there fair share of curb rash over the years and one is actually pretty bent from the previous owner. Haha. |

OP - you hit a rock in the road. Who's responsibility is it to keep you from hitting it? The city? Or your own? On a similar line of thought - there is another car on the road.
